Abstract

Adopting an adaptive regulation approach, this article identifies fourcore components of the legal framework for supporting innovative start-ups:enterprise law, investment law, financial regulation, technology sandboxes, and theprotection of digital intellectual property. Drawing on comparative analysis withinternational practice, the article identifies existing legal gaps, including the absenceof a dedicated sectoral law, the lack of cross-sectoral sandbox arrangements, and theabsence of a personal data protection law. It then recommends a roadmap forimproving the regulatory environment for innovative start-ups in Viet Nam through anopen, flexible, risk-based approach that balances the promotion of innovation with theprotection of the public interest in the digital economy era.Keywords: Innovative start-ups; Legal framework; Data protection; Adaptiveregulation.
